For 50 years, the National Environmental Policy Act (NEPA) has provided guidance to federal agencies in identifying and publicly disclosing any significant environmental, social, economic, or public health impacts a federal action may have before a decision is made. But now, NEPA protections are under attack like never before.

The White House Council on Environmental Quality (CEQ) has now released its draft NEPA rule. It went out on January 10, 2020, with a 60-day public comment period ending on March 10, accompanied by a public hearing in Denver on February 11 and a public hearing in Washington, D.C. on February 27.

As you might imagine, the CEQ draft rule is problematic in a number of ways. For instance…

It sets arbitrary and difficult deadlines for environmental impact statements and assessments.

It narrows NEPA’s scope and eliminates climate change analysis of projects.

It will have a disproportionate impact on marginalized communities, increasing their pollutant exposure, and diminishing public health outcomes.

It restricts public comments and limits the opportunity and impact of lawsuits.

It’s vital we get as many comments as possible to oppose these changes.
